Introduction and Acceptance
Welcome to SurgeryTrips (“we”, “us”, or “our”). SurgeryTrips is a platform operated by Yonas Valentin Mougaard Kristensen (located at Callisensvej 20, 1. th., 2900 Hellerup, Denmark) that connects patients in Denmark (and other Nordic countries) with clinics abroad (such as in Turkey and Tunisia) for plastic surgery, dental, cosmetic, and similar medical procedures. By accessing or using our website (the “Site”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Site. Users must be at least 18 years old (or the age of legal majority in your country) to use our services. These Terms constitute a binding agreement between you (the "User") and SurgeryTrips. Please read them carefully.
Services Provided – Not Medical Advice
SurgeryTrips is a lead-generation and information service. We help you gather information about elective medical treatments and connect you with third-party clinics and healthcare providers (“Clinics”) abroad. However, we are not a medical provider and do not give medical advice or treatment. Any information on our Site is for general informational purposes only and is not a substitute for professional medical advice. Communication with any Clinic through our platform does not establish a doctor-patient relationship with SurgeryTrips. Always seek the advice of a qualified healthcare professional for any medical questions or decisions about treatments.
User Responsibilities and Proper Use
By using SurgeryTrips, you agree to:
Provide Accurate Information: If you create an account or fill out a contact/request form, you must provide true, current, and complete information (including any personal or medical details you choose to share). Do not impersonate others or provide information you have no right to share.
Use for Intended Purpose: Use our Site only for its intended purpose of learning about treatments and connecting with Clinics. Do not attempt to copy our website, our concept, or use our content for a competing service. You are expressly not granted any rights to copy, reproduce, modify, distribute, or create derivative works from our Site content, design, or business concept. The idea and business model of SurgeryTrips are proprietary and protected—attempts to replicate or misappropriate our platform’s concept or content are prohibited.
Lawful Conduct: You agree not to use the Site for any unlawful, fraudulent, or harmful purpose. This includes not posting or transmitting any material that is defamatory, obscene, invasive of privacy, infringing of intellectual property, or otherwise objectionable. You must not attempt to gain unauthorized access to our systems or data, nor engage in any activity that could disrupt or impair the functionality of our Site (e.g., introducing viruses or performing attacks).
No Misuse of Communication Tools: If our platform allows you to communicate with Clinics or other users, you will use these tools only to discuss legitimate medical travel inquiries. You will not send unsolicited commercial messages, spam, or harassing content.
If you violate these Terms or any applicable laws, we may terminate or suspend your access to SurgeryTrips without notice.
You are responsible for maintaining the confidentiality of your login credentials (e.g., password) and for all activities that occur under your account.
You must notify us immediately at contact@surgerytrips.com if you suspect any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to secure your account.
We reserve the right to refuse registration or cancel accounts that violate these Terms or that we suspect are used for unauthorized or illegal activity.
Clinic Responsibilities: If you are a Clinic using SurgeryTrips to connect with potential patients or to display information, you agree to the following:
Accurate Information: You will provide accurate, truthful, and up-to-date information about your services, qualifications, pricing, and any images or media. It is your responsibility to promptly update any information on our Site that is no longer accurate (for example, if prices change or a doctor’s credentials change).
Compliance and Licensure: You represent that you and your practitioners hold all necessary licenses, certifications, and approvals required by the jurisdiction in which you operate to provide the advertised treatments. You agree to comply with all applicable laws and professional regulations. SurgeryTrips is not responsible for verifying the licensure or qualifications of Clinics; however, if we become aware of any non-compliance or issues, we reserve the right to remove or suspend the Clinic’s listing.
Content Ownership and Rights: You must only upload or provide content (such as text descriptions, photos, videos, logos, or other media) that you have lawful rights to use. By providing content to SurgeryTrips, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content on our platform for the purpose of operating and promoting our services. You represent and warrant that such content does not infringe any third-party intellectual property or privacy rights. Clinics must own or have obtained all necessary rights/permissions for any images or materials they upload. If you use before-and-after photos or similar materials, you must have the patient’s consent and any required rights to share those.
Indemnity for Content: Clinics agree to indemnify and hold SurgeryTrips harmless from any and all claims, damages, or liabilities arising from the Clinic’s content or information. This includes, but is not limited to, claims that content is infringing, defamatory, or violates privacy or other laws. If a third party alleges that content you provided infringes their copyright or other rights, you will bear full responsibility for such claims and any costs or losses incurred by SurgeryTrips due to such content.
Patient Communications and Data: You agree to handle any personal data of patients (leads) we forward to you in compliance with applicable data protection laws (including GDPR if applicable). You will use such data only for the purpose of responding to the patient’s inquiry and providing services, and you will implement appropriate safeguards to protect it. (Refer to our Privacy Policy for details on data sharing). You also agree not to spam or aggressively solicit patients who have contacted you via SurgeryTrips beyond addressing their inquiry, unless they expressly consent to further communication.
Third-Party Content: Except for content provided by SurgeryTrips, all information and materials on our Site concerning Clinics or treatments (such as descriptions, photos, reviews, pricing, results, etc.) are provided by the Clinics or other third parties. We do not create, own, or guarantee the accuracy of third-party content. While we may perform basic reviews or moderation (for example, to check that content is not obviously inappropriate), SurgeryTrips does not independently verify every claim made by Clinics (such as success rates, credentials, or pricing). Clinics are solely responsible for their own content.
No Endorsement: The appearance of a Clinic or mention of a procedure on SurgeryTrips does not constitute an endorsement, recommendation, or guarantee by us regarding the quality, safety, or suitability of that Clinic or procedure. SurgeryTrips simply provides information and connection opportunities. Users should perform their own due diligence and consult healthcare professionals before choosing a Clinic or procedure.
Our Trademarks and Name: “SurgeryTrips” and our logo are trademarks or trade names owned by Yonas Valentin Mougaard Kristensen. You may not use our name or logos in any manner likely to cause confusion about the source of goods or services or in any way that implies endorsement without our prior written consent.
License to Use Site: We grant you a limited, revocable, non-transferable, non-exclusive license to access and use SurgeryTrips for your personal, non-commercial use, solely for the purpose of researching medical travel options or, if you are a Clinic, for listing your services. No other use is permitted. You must not copy, distribute, modify, publicly display, perform, republish, download, store, or transmit any of the material on our Site except as inherently necessary for viewing the Site in your web browser.
No Rights to Ideas or Concept: In addition, you acknowledge that the concept and business model of SurgeryTrips (connecting patients with overseas clinics for medical procedures through an online platform) is a result of our significant effort and is protected by law. You have no right to copy or use our platform’s idea, business model, or unique compilation of services for any commercial purpose. Any attempt to create a similar competing service by unlawfully copying our content, scraping our clinic listings, or leveraging confidential information from our Site may violate intellectual property, database rights, and unfair competition laws. We reserve the right to take legal action against such misuse.
Third-Party Marks: All other trademarks, service marks, or logos appearing on SurgeryTrips that are not owned by us (for example, Clinic names or logos) are the property of their respective owners. Their appearance on our Site is for identification purposes only and does not imply any affiliation with or endorsement by us.
If you wish to request permission to use any content from our Site beyond what is permitted by these Terms or by law (such as a brief quotation under “fair use”), please contact us for written permission.
Information “As-Is”: All information on the Site is provided on an “as is” and “as available” basis. SurgeryTrips makes no warranties or representations of any kind, express or implied, about the completeness, accuracy, reliability, or availability of information on the Site. We do not warrant that the content is up-to-date or error-free. For example, prices, descriptions, or other details provided by Clinics might change without our knowledge. It is the Clinic’s responsibility to provide accurate information, and the user’s responsibility to verify details with the Clinic.
No Warranty of Service: We also do not guarantee that the Site will always be available, secure, or free of errors or viruses. To the extent allowed by law, we disclaim all warranties, either express or implied, regarding the Site and its content, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Use of our Site is at your own risk.
No Liability for Clinic Services: To the maximum extent permitted by law, SurgeryTrips (and our owners, officers, employees, and agents) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) our Site or any engagement you have with a Clinic listed on our Site. This includes, but is not limited to, personal injury, complications, pain and suffering, medical negligence, emotional distress, lost profits, loss of data, or damage to property, even if caused by a Clinic that you accessed through our platform. We do not assume responsibility for any miscommunications, misunderstandings, or disputes that may occur between you and any Clinic.
No Liability for Site Issues: SurgeryTrips is also not liable for any damages resulting from: (a) any errors or omissions in our Site content, (b) any unauthorized access to or use of our servers and/or any personal data stored therein, (c) any interruption or cessation of transmission to or from our Site, (d) any bugs, viruses, or harmful code that may be transmitted through our Site by third parties, or (e) any third-party links or content accessed via our Site.
Cap on Liability: If, notwithstanding the above, SurgeryTrips is found liable to you for any damage or loss arising out of or connected to your use of our Site or services, to the extent permitted by law our total liability shall not exceed the amount of DKK 1,000 (one thousand Danish Kroner) or the equivalent in your local currency. If you are using the Site as a consumer, this limitation does not affect any mandatory rights you have under applicable law that cannot be lawfully limited or excluded.
No Limitation for Certain Losses: Nothing in these Terms shall exclude or limit our liability for death or personal injury directly caused by SurgeryTrips’ gross negligence or willful misconduct, or for our fraudulent misrepresentation, or any other liability that cannot be excluded under law. However, in no event will we be liable for any act or omission of a Clinic, as Clinics bear their own professional and legal responsibilities.
You agree that the above disclaimers and limitations of liability are fair and reasonable given the nature of our service (a free informational referral platform). Without these limitations, we would not be able to offer this service to you.
For example, if you (as a user) post a review or comment on our Site that libels a Clinic, or if you (as a Clinic) provide infringing images or misleading information that causes a dispute, and SurgeryTrips faces a claim as a result, you must indemnify us for our losses. Clinics specifically agree to indemnify SurgeryTrips for any claims arising from the Clinic’s failure to fulfill its obligations to a patient or violation of any laws or regulations in the provision of its services. This includes any claims by patients for malpractice, injury, or dissatisfaction with the Clinic’s services, except to the extent such claim arises from SurgeryTrips’ own wrongdoing. In practice, SurgeryTrips simply introduces users to Clinics and is not responsible for the outcome; Clinics will bear responsibility for their own patient interactions and outcomes.
Privacy
Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. Our Privacy Policy is considered part of these Terms. By using the Site, you consent to the collection and use of information as described in the Privacy Policy. Given the nature of our service (involving sensitive personal and health information), we take privacy very seriously. Please review the Privacy Policy below for details.
Cookies
For information on how we use cookies and similar tracking technologies on our Site, please review our Cookie Policy (see below). The Cookie Policy is also incorporated into these Terms by reference. By using the Site, you agree that we can use cookies as described, subject to your choices and consent provided via our cookie consent banner.
Modifications to Terms
SurgeryTrips may update or modify these Terms from time to time. If we make material changes, we will notify users by posting a prominent notice on our Site or via email (if you have provided one) prior to the change becoming effective. The “Last Updated” date at the top of the Terms indicates when the latest changes were made. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Site. It is your responsibility to check this page periodically for updates.
Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them or the use of the Site are governed by the laws of Denmark, without regard to its conflict of law principles. However, if you are a consumer residing in another country, you may have mandatory legal rights under the consumer protection laws of your country; these Terms are not intended to override those rights.
Jurisdiction: Any dispute arising from these Terms or your use of SurgeryTrips that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the Danish courts. The venue for any proceedings shall be Copenhagen, Denmark, unless another venue is required by mandatory law. By using the Site, you agree to submit to the jurisdiction of the courts of Denmark for such legal proceedings.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions of the Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Entire Agreement
These Terms (along with the incorporated Privacy Policy, Disclaimer, and Cookie Policy) constitute the entire agreement between you and SurgeryTrips regarding your use of the Site and supersede any prior agreements or understandings (whether oral or written) relating to the same subject matter.
